These Terms & Conditions ("Terms") are a legal agreement between you and JTR Labs LLC ("we", "us", or "our") governing your use of the Waiting On mobile application and related services (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License to use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal, non-commercial use, in accordance with the Apple Media Services Terms and the Standard End User License Agreement (EULA). You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent such restrictions are prohibited by applicable law.
2. Eligibility
You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to enter into these Terms and to make purchases. By using the App you represent that you meet these requirements.
3. Subscriptions & in-app purchases
The App offers a free tier and an optional paid upgrade ("Waiting On Premium"), available as auto-renewing subscriptions and/or a one-time purchase.
- Billing. All purchases are processed by Apple through your Apple Account. Prices are shown in the App and may vary by region and over time.
- Auto-renewal. Auto-renewing subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
- Managing & cancelling. You can manage or cancel a subscription in the App Store under your Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly; please contact Apple Support for billing issues.
- Free tier. The free tier may limit certain features (for example, the number of active cases). We may change the features included in each tier; we will not reduce features you have already paid for during a paid period.
4. Acceptable use
You agree to use the App only for lawful purposes and not to: (a) violate any law or the rights of others; (b) interfere with or disrupt the App or its security; or (c) use the App in any way not permitted by these Terms or the App Store rules.
5. Your content
You retain all rights to the information you enter into the App ("Your Content"). Your Content is stored on your device and, if you enable iCloud sync, in your own private iCloud account. We do not collect Your Content (see our Privacy Policy). You are solely responsible for Your Content and for maintaining your own backups.
6. No professional advice
Waiting On is an organizational and productivity tool. It helps you keep track of follow-ups across areas such as insurance, healthcare, finance, legal, and government matters, but it does not provide legal, medical, financial, insurance, tax, or other professional advice, and any draft messages it helps you compose are suggestions only. You are responsible for reviewing and deciding what to send and what actions to take. Always consult a qualified professional for advice specific to your situation.
7. Intellectual property
The App, including its design, software, text, graphics, logos, and the "Waiting On" name, is owned by JTR Labs LLC and protected by intellectual-property laws. Except for the limited license granted above, these Terms do not transfer any rights to you.
8. Third-party services
The App integrates with services and features provided by Apple (such as iCloud, Apple Intelligence, StoreKit, Reminders, Calendar, Mail, and Messages). Your use of those features is also subject to Apple's terms and policies. We are not responsible for third-party services, and links or integrations do not imply our endorsement.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT REMINDERS OR NOTIFICATIONS WILL ALWAYS BE DELIVERED ON TIME. YOU USE THE APP AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JTR LABS LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR MISSED DEADLINES OR OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless JTR Labs LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or applicable law.
12. Termination
These Terms apply while you use the App. You may stop using the App and delete it at any time. We may suspend or terminate your access if you violate these Terms or as required by law. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.
13. Apple App Store terms
The following applies because the App is distributed through the Apple App Store:
- These Terms are between you and JTR Labs LLC only, and not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
14. Governing law
These Terms are governed by the laws of the United States and the State in which JTR Labs LLC resides, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in that State, except where prohibited by applicable law. If you are a consumer, you may have additional rights under the mandatory laws of your country of residence, which are not affected by this section.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
