These Terms of Service ("Terms") form a binding agreement between you and JTR Labs ("we," "us," "our") governing your access to and use of the Gloam macOS application (the "App") and our website at jtrlabs.com. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use Gloam on any Mac you own or control. This license does not include any right to:
Gloam is distributed through the Mac App Store. Your purchase, refund, and family-sharing rights are governed by Apple's Media Services Terms. Apple — not JTR Labs — handles payments, receipts, and refund requests.
Gloam Pro may be sold as a one-time purchase or as an auto-renewing subscription. Pricing, billing intervals, and cancellation are managed by Apple through your Apple ID. You can cancel at any time via System Settings → Apple ID → Subscriptions on macOS.
We may release bug fixes, improvements, and feature additions at our discretion. We may also retire features that are no longer maintained. JTR Labs is not liable to you for any modification, suspension, or discontinuation of the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. GLOAM ADJUSTS YOUR DISPLAY'S COLOR TEMPERATURE BUT IS NOT MEDICAL SOFTWARE. IT IS NOT INTENDED TO DIAGNOSE, TREAT, OR PREVENT ANY MEDICAL CONDITION, INCLUDING EYE STRAIN OR SLEEP DISORDERS. CONSULT A QUALIFIED HEALTHCARE PROVIDER FOR HEALTH ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL JTR LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PRIOR 12 MONTHS, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations; in those cases, the above limitations apply to the maximum extent permitted by law.
If you obtained Gloam from the Mac App Store:
This agreement is effective until terminated. We may terminate it without notice if you violate any term. Upon termination, you must stop using Gloam and delete it from your devices. Sections 6, 7, and 10 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware. If you reside in the European Economic Area or the United Kingdom, this section does not deprive you of mandatory consumer protections under the law of your country of residence.
We may update these Terms from time to time. Material changes will be communicated in a release note or in-app. Your continued use of Gloam after the changes take effect constitutes acceptance of the updated Terms.
