These Terms of Service ("Terms") are an agreement between you and JTR Labs LLC ("JTR Labs," "we," "us") for the Gloam website at jtrlabs.com/gloam and for the downloadable Gloam apps for Mac and Windows (together, "Gloam"). By downloading, installing, buying, or using Gloam, you agree to these Terms. If you do not agree, do not download or use it.
Where these Terms differ from the site-wide jtrlabs.com terms, these Terms govern Gloam.
If you follow these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use Gloam on Macs and Windows PCs that you own or control. You may not:
Free and Pro use the same installer. Pro features turn on only after the app accepts a license key that we issued for a paid order. A control in the app cannot turn Pro on by itself.
You buy Gloam Pro from JTR Labs LLC. Stripe processes that payment for JTR Labs LLC at the price shown on the Gloam page when you pay. There is no subscription and no automatic renewal. We do not bill you again for that purchase.
"Lifetime" means the license does not expire, is not a subscription, and includes every future update we release for Gloam. Those updates are included in the price you already paid.
After a successful payment, the thank-you page shows the license key for that purchase. Enter it in Gloam from the menu, under Enter license key…. The key is for your own computers. If you leave before the key appears, email [email protected] with your Stripe receipt and we will send it.
Gloam is not sold through the Mac App Store. Apple does not process this purchase, and Apple's refund system does not apply to it.
JTR Labs LLC is the seller. Pro purchases are final, except where the law requires a refund. Email [email protected] if you have a question about a charge.
Download Gloam from the links on jtrlabs.com/gloam. Those links point at the current Mac disk image and the Windows zip files.
Signing identifies the publisher. It is not a promise that the software is free of every risk. Compare the checksum published on the download page if you want to confirm the file.
A Pro lifetime license includes all future updates of Gloam. We will make those updates available to you at no extra charge. Some displays ignore color adjustments, including certain new Macs and Windows monitors with HDR turned on. On those displays Gloam uses a color tint instead, and the result is approximate.
Gloam changes the color and brightness of your screen. It does not diagnose, treat, cure, or prevent any disease or condition, including eye strain and sleep problems. The eye-comfort score is a product hint, not a clinical measurement. For health decisions, talk to a qualified clinician.
GLOAM AND THE GLOAM WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT A WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that Gloam will be uninterrupted, that every display will respond to it, or that a particular health or sleep result will occur.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JTR LABS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING OUT OF GLOAM, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THAT PURCHASE.
Some places do not allow these limits. In those places, the limits apply only as far as the law allows. These Terms do not take away rights that a consumer-protection law gives you and does not let us waive.
You may stop using Gloam at any time by deleting it. We may end the license if you break these Terms. Sections 7, 8, 9, and 11 still apply after the license ends.
These Terms are governed by the laws of the United States and of the state in which JTR Labs LLC is organized, without regard to conflict-of-laws rules. Courts in that state are the forum for a dispute, except that this section does not remove mandatory consumer protections in your country of residence, including in the European Economic Area and the United Kingdom.
We may update these Terms by posting a new version on this page and changing the date above. If a change is material, we will also note it on the Gloam page or in a release note. The version posted here is the one that applies.
