These terms are a plain-language agreement between you and JTR Labs LLC ("JTR Labs," "we," "us"), the maker of the Groundwell mobile application ("Groundwell," "the app"). By downloading, installing, or using Groundwell, you agree to these terms. If you don't agree, please don't use the app.

1. What Groundwell is

Groundwell is an educational and exploratory tool. It helps you find outdoor places near you, time the periods you spend grounding (going barefoot on natural surfaces), and view live environmental information — soil moisture, weather, UV, air quality, and the geomagnetic Kp index — for the land around you.

2. Not medical advice

This is the most important thing on this page. The scores and metrics Groundwell shows describe environmental conditions estimated from public soil, weather, and geological data. They are not measurements of your body and not medical information.

Groundwell is not a medical device. It does not diagnose, treat, cure, or prevent any disease, and it makes no claim of any health benefit. Nothing in the app is a substitute for professional medical advice. Always consult a qualified healthcare provider for any question about your health, and use common sense and your own judgment about where and when it is safe to be barefoot outdoors.

3. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Groundwell on Apple devices that you own or control, for your own non-commercial use, in accordance with these terms and with Apple's Licensed Application End User License Agreement (the "Standard EULA"). Where these terms and the Standard EULA conflict, the Standard EULA governs for the parts it covers.

4. Acceptable use

You agree not to:

You are responsible for your own safety outdoors, including awareness of terrain, weather, wildlife, plants, water, sun exposure, private property, and local rules about access to public and natural areas.

5. Third-party data and services

Groundwell displays information from public, third-party sources that we do not own or control:

This data is provided to you "as is." It may be incomplete, delayed, approximate, or wrong, and place names and boundaries from community map data can be inaccurate. We make no warranty about it and are not responsible for it. Your use of map and weather data may also be subject to those providers' own terms.

6. Your data

Groundwell runs entirely on your device. There is no account, and we do not operate servers that store your information. Your name, sessions, Earth Connectivity Points, and achievements are kept in local storage on your device. See the Privacy Policy for the full picture.

7. Intellectual property

Groundwell, its name, logo, design, original text, scoring formulas, and software are owned by JTR Labs LLC and protected by intellectual-property laws. These terms don't transfer any ownership to you — only the limited licence in Section 3. Third-party data and map tiles remain the property of their respective owners.

8. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data it shows is accurate, current, or complete. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, JTR Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or injury arising out of your use of — or inability to use — the app or any data it displays, even if we have been advised of the possibility. Because Groundwell is provided free of charge, our total liability to you for any claim relating to the app will not exceed twenty US dollars ($20). Nothing in these terms limits liability that cannot be limited by law.

10. Changes to the app and these terms

We may update, change, or discontinue features of the app at any time. We may also update these terms; when we make a material change, we'll update the date at the top of this page. Continuing to use the app after a change means you accept the updated terms.

11. Termination

You may stop using Groundwell at any time by deleting it, which removes the data stored on your device. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive — including Sections 7 through 9 — will survive termination.

12. Apple App Store terms

These terms are between you and JTR Labs LLC only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal-or-regulatory, or consumer-protection claims. If a third party claims the app infringes their intellectual-property rights, JTR Labs LLC, not Apple, is responsible for handling that claim. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

13. Subscriptions (Groundwell Pro)

Groundwell offers an optional auto-renewable subscription, Groundwell Pro, which unlocks premium map layers, space-weather alerts, and unlimited session history with export. Pro is offered as a monthly plan and a discounted annual plan; the current prices are shown in the app before you purchase.

Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings after purchase. All purchases are processed by Apple; Groundwell never receives or stores your payment details, and runs no servers. Refunds are handled by Apple under its standard terms of use (EULA); we generally cannot issue them directly.

14. Governing law

These terms are governed by the laws of the United States and of the state in which JTR Labs LLC is organized, without regard to conflict-of-laws rules. If any provision is found unenforceable, the rest remains in effect.
